Privacy Policy

Last updated: March 13, 2026

This Privacy Policy describes how Swish ("Swish", "we", "us", or "our") collects, uses, and discloses information when you use our AI-powered customer engagement platform (the "Service").

1. Who We Are

Swish is a business-to-business (B2B) SaaS platform. Our customers ("Customers") are companies that use the Service to manage and engage their own end-users ("End Users"). This policy covers both Customers and, where applicable, their End Users whose data is processed through the Service.

2. Information We Collect

2.1 Information You Provide

  • Account information: name, email address, company name, and billing details when you sign up.
  • Configuration data: business goals, tactics, campaign settings, and other inputs you enter into the Service.
  • Communications: messages you send us via email or support channels.

2.2 Data Processed on Your Behalf

When you connect third-party integrations, we process data from:

  • PostHog: user analytics events, user properties, and session data from your PostHog project.
  • Stripe: subscription status, plan details, and billing history for your End Users.
  • Attio: CRM records, contact attributes, and deal stages.

This data belongs to you and your End Users. We act as a data processor on your behalf.

2.3 Automatically Collected Information

  • Log data (IP address, browser type, pages visited, timestamps).
  • Cookies and similar tracking technologies necessary for authentication and platform functionality.

3. How We Use Information

  • Provide, operate, and improve the Service.
  • Generate AI-powered engagement strategies and campaign content on your behalf.
  • Send transactional emails and operational notifications.
  • Authenticate users and manage access.
  • Respond to support requests.
  • Comply with legal obligations.

We do not sell your data or your End Users' data to third parties.

4. AI-Generated Content

The Service uses large language models (LLMs) to generate engagement strategies, email copy, and other content. Inputs you provide (including End User data) may be sent to our AI providers for inference.

We do not use your data to train third-party AI models unless you explicitly opt in. AI outputs are not guaranteed to be accurate or appropriate and should be reviewed before use.

5. Sharing of Information

We may share information with:

  • Sub-processors: cloud infrastructure providers (e.g., AWS), database services, email delivery providers, and AI inference providers — all bound by confidentiality obligations.
  • Your integration partners: when you instruct us to send campaigns via Loops, Intercom, Customer.io, WhatsApp, LinkedIn, or Slack, the relevant data is transmitted to those platforms per your configuration.
  • Legal authorities: if required by applicable law or valid legal process.
  • Business transfers: in connection with a merger, acquisition, or sale of assets, with notice to you.

6. Data Retention

We retain account information for as long as your account is active or as needed to provide the Service. Analytics event data synced from PostHog is retained in our systems for up to 24 months unless you request earlier deletion.

You may request deletion of your data at any time by contacting us.

7. Security

We implement industry-standard technical and organizational measures to protect your data, including encryption in transit (TLS) and at rest.

No system is completely secure. We cannot guarantee absolute security.

8. International Transfers

Our infrastructure is hosted in the EU (AWS eu-west-3). If your organization is located outside the EU, your data may be transferred to and processed in the EU.

By using the Service, you consent to such transfers.

9. Your Rights

Depending on your jurisdiction, you may have rights to:

  • Access, correct, or delete your personal data.
  • Restrict or object to processing.
  • Data portability.
  • Withdraw consent where processing is based on consent.

To exercise these rights, contact us at legal@swish.is.

10. Children's Privacy

The Service is not directed to individuals under 18. We do not knowingly collect personal information from minors.

11. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by email or via a notice in the Service.

Continued use after the effective date constitutes acceptance of the updated policy.
